Nova Privacy Policy Statement

The Nova Academy of Arts Sdn. Bhd. ("Nova") pioneers a new era of music education in Malaysia through smart technology, group-based learning, and a bold new approach in learning music that is designed for everyone. Our mission is to move, connect, heal, and shape lives through the power of music — inspiring every learner to belong, create, and grow.

This privacy policy sets out how we collect, use, disclose and protect the information you give us through this website, our mobile chat applications, our social media platforms, and other channels of communication. Nova believe that protecting the personal data of each customer (a “customer” or “you”) is Nova's obligation under laws and ordinances as well as an essential social responsibility. Nova sets forth this “Privacy Policy” as follows (this “Privacy Policy”), respects rights regarding your personal data, and protects such rights.

1. Sources and categories of personal data

​Nova may obtain the following personal data.

  • Name, age, date of birth, email address and physical address, phone number, sex, occupation, place of work or study, information regarding social media, user ID and account, membership number, information regarding visits to stores, products purchased

  • Information provided via questionnaires or campaigns

  • Information necessary for product or service transactions or support (serial number, purchasing history, credit card information, bank account numbers, and the like)

  • Information generated from use of products and services (methods of use for products, frequency of use, settings information in devices used, and the like)

  • Information generated from inquiries to Nova (your phone number and voice recordings obtained upon inquiries, history of requests for repairs and the like, information regarding product or service difficulties, and the like)

  • Information generated from transactions with Nova (history of participation in concerts, events, auditions, and contests held or co-sponsored by Nova (including voice recordings and information regarding instrumental or singing performances), history of participation in music school classes, courses, and the like operated by Nova (including voice recordings and information regarding instrumental or singing performances), purchasing or use history for products and services handled by Nova, history of licenses, use, and the like for artworks (including musical pieces) in which Nova owns rights

  • Downloading and status of use of software, etc.

  • Information generated from the use of software or the internet (information obtained from cookies, etc., information regarding browsers and operating systems of devices you use, location information, service use information, webpages you browse, links you click, emails from Nova you open, IP addresses, and the like)

  • Types of devices, their O.S. versions, countries of access, number of users, access dates and times

  • Information provided by questionnaires or campaigns conducted by outside services with your prior consent, information disclosed by customers

  • Information provided by business operators who perform services using information that can distinguish between, but not identify, individual persons (advertising identifiers, etc.)

  • Information on social media services affiliated with Nova websites, etc. (with your consent)

 
In addition to the above items, Nova may also obtain the following personal data.

  • Your National Registration Identity Card (NRIC) or Passport number

  • Photos and videos of yourself collected or generated from interactions or transactions with Nova during auditions, roadshows or contest held or co-sponsored by Nova and history of participation in music school classes, courses, and the like operated by Nova (which include photos and videos of yourself)

 
If Nova obtains your personal data, it obtains your personal data in a proper and lawful manner.

1.1 Unless otherwise stated, all personal data obtained by Nova is obligatory. If you do not provide and/or allow us to collect and process all the obligatory personal data as requested, we will not be able to keep complete personal data about you, thus affecting our ability to accomplish the purposes stated below.

2. Purposes of use of personal data

Nova uses personal data obtained from customers within the scope of the following purposes.

  • Provision, maintenance, protection, and improvement of Nova’s products and services, development of new products and services, provision of information on campaigns, new products, and the like, implementation of questionnaires, after-sales service for products, and protection of customers

  • Provision of information and content that suit each customer’s preferences

  • Contact regarding transactions, etc.

  • Provision of products and services handled by Nova

  • Performance of agreements executed with Nova (payment processing, etc.)

  • Management of copyrights and neighboring rights for sound sources

  • Implementation of service activities and handling of repairs during the warranty period and after-sales care after such implementation of service activities and handling of repairs

  • Provision of notices regarding products and services handled by Nova and announcements regarding events, etc.

  • Provision of announcements regarding products, services, events, and the like of other companies or groups, such as companies affiliated with Nova

  • Ascertainment of your preferences and wishes in order to provide appropriate information and to develop appropriate products and services

  • Provision of information that suits your preferences by integrating information possessed by Nova with information obtained from other companies

  • Responses to inquiries, requests for brochures, or other requests, etc.

  • Exercise of rights or performance of obligations under agreements, laws, and the like

  • Screening conducted when applications are submitted for rental instruments, etc.

  • Other purposes based on your prior consent​​​​

3. Safety management of personal data

Nova implements technical, physical and organizational measures to prevent unauthorized access to personal data and loss, destruction, falsification, divulgence, and the like of personal data and endeavors to protect your personal data through the establishment of a safety management system.

4. Sharing of personal data

Nova may entrust to a third party all or part of its operations regarding the processing of your personal data. Nova does not approve the use or provision of your personal data by any contractor unless it is necessary for a contractor to conduct such use or provision in order to perform the entrusted operations or to comply with laws and ordinances. Nova requires each contractor to protect personal data under an agreement.
 
Nova may disclose and transfer your personal data to third parties, including:
 

  • where required by any regulatory authority of competent jurisdiction;

  • to discharge any legal obligation imposed on Nova by law or pursuant to an order of a court of competent jurisdiction;

  • to Nova's auditors, consultants, accountants, or other financial or professional advisers where needed for corporate audits or to investigate or respond to a complaint or security threat;

  • to any of Nova's related, affiliated and/or associated companies, whether within or outside Malaysia;

  • to other third-party service providers who provide services on Nova's behalf or when Nova collaborates with them in respect of particular products or services (“Providers”). Such Providers may provide technological maintenance or work on Nova's behalf to help fulfill business transactions, such as providing online cloud services. Such Providers may also collect information on Nova's behalf on Nova's websites. These Providers are required to comply with the terms of Nova's privacy policies and may not use your personal information other than on Nova's behalf and subject to contracts that protect the confidentiality of the information; and.

 
As part of our provisions of services to you and/or Nova's operations, any of your personal data may be transferred, accessed, stored or processed in other jurisdictions, such as the United States, whose data protection laws may differ from Malaysia. In such cases, Nova will handle your personal data in accordance with this Nova Privacy Policy Statement and ensure that Nova's data processor complies with applicable data privacy laws.​​

5.  Retaining of personal data

Nova stores and uses personal data obtained from customers only for the period necessary to perform the purposes of use. If not, then Nova will destroy it by purging it from our electronic, manual, and other filing systems according to Nova's internal procedures and schedules.

Storage Security
The security of your personal information is important to Nova, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While Nova strives to use commercially acceptable means to protect your personal information, Nova cannot guarantee its absolute security. 

6. Processing of children’s personal data

With respect to a child’s personal data, Nova obtains consent from statutory agents, such as a person with parental authority over that child, and takes other necessary steps in accordance with applicable laws, ordinances, and the like.

7. Third-party websites and data privacy

The website has links to other websites. Other websites linked may have their own Privacy Policy which differs from our policy and users are strongly advised to read through and understand the Privacy Policy for every website visited. 

8. Website browsing and cookies

Nova may generate cookies and use other similar technologies on Nova’s websites. These enable Nova to provide each customer with more customized services and advertisements.

Nova complies with applicable laws, ordinances, and guidelines regarding personal data and performs its social responsibilities as a company.

Nova continually reviews and improves its compliance program (its program for complying with laws, ordinances, and the like) in order to ensure reliable performance of personal data protection.

12. Revision of this Privacy Policy

Nova may amend, revise, add to, or delete the contents of this Privacy Policy in accordance with Nova’s internal policies, technological developments, or applicable laws and ordinances. 

This Privacy Policy is effective as of the below update date and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
